These terms were modified on April 2020.

The present purchasing terms ("terms") applies when you purchase products online at boutique.simacanada.ca ("site"), including terms and conditions that govern use of the site.

Order Process and Shipping

When you make an online purchase, an order confirmation will be emailed to you. A shipping confirmation will be emailed to you once the order has been shipped, which will include a tracking number to enable you to verify each stage of the delivery of your package. boutique.simacanada.ca  provides delivery everywhere in Canada, with the exception of certain remote areas.

Payment by Credit Card

Payment will be pre-authorized on your credit card at the moment of purchase, and the credit card will be charged for each item as it is shipped. As delivery times may vary according to the item, your credit card statement may indicate a separate charge for each item shipped. Before charging your credit card, an authorization must be obtained for the amount of your order. For items with longer delivery times, a new credit card authorization will be needed, and funds will continue to be set aside (by the issuing company) for the balance of your order, until boutique.simacanada.ca  charges your card when the item is shipped. All credit cards must be valid and authentic, and you must be authorized to use it. If the charge is not authorized or accepted, we reserve the right to cancel your order without notice and with no liability or obligation to you. We reserve the right to stop accepting credit cards from one or several issuers at any time.

Warranty, Returns and Exchanges

Group Sima Inc. guarantees complete satisfaction for goods purchased. However, if you wish to return or exchange goods, directly to boutique.simacanada.ca, please contact our customer services, within 10 days following the invoice date, at boutique.simacanada.ca or by calling 1-800-363-0531, weekdays from 9:00 to 4:30 EST. Exceptions may apply (see "Special Conditions" below).  You will be responsible for return shipping costs. After 10 days, a restocking charge of 25% will be applied to all non-defective products returned.

In cases where products are deemed defective, the manufacture warranty applies to any product sold through this website. Therefore, the policies described in the Purchasing Terms are subjected to the conditions in the manufacturer's official warranty.

Special Conditions

All products must be returned and received in good condition for resale, and in their original packaging. Group Sima Inc. reserves the right to apply additional charges of up to 25% to 50%of the price of the product for re-packaging and re-marketing. These charges will be deducted from the amount of credit issued to the buyer. If this applies, Group Sima Inc. will notify the buyer.

All products requiring assembly cannot be returned unless the product is defective. If this product is found to be defective, Groupe Sima Inc reserves the right to replace the defective part when possible.

Limitations on Responsibility

Group Sima Inc. assumes no responsibility concerning labor costs, material and other charges incurred such as, transport or water delivery, to replace any defective product, or for any repairs following damages caused by use of defective products purchased through this site. Group Sima Inc. also assumes no liability for loss or damage resulting from non-conformance to warnings, instructions relating to safety or other safety guidelines issued by the manufacturer.

Any claims against Group Sima Inc., whether based on responsibility, contractual or otherwise (including negligence), relating to, or resulting from sale, delivery, installation, repair or use of products sold to the buyer, will be limited to the purchase price of the product found defective, less any special conditions that may apply, if applicable and specified in the preceding paragraph.

The responsibility of Group Sima Inc. relating to the sale of products is strictly limited to the replacement of these products, and Group Sima Inc. assumes no responsibility for damages, whether loss of pleasure or business interruption, or for any claim for incidental, indirect, special or punitive damages.

Changes or Order Cancellations

You orders are processed electronically. We cannot make changes to the shipping address once the order has been processed. Once the product is sent to the delivery agent, you will receive an email confirming shipping with up-to-date tracking information, including an estimated delivery date. Orders cannot be cancelled nor modified online if the goods have already been shipped. If you wish to change or cancel an order after it has been shipped, contact us at boutique@simacanada.ca or by calling 1-800-363-0531, weekdays from 9:00 to 4:30 EST,

Modifications of Terms

On occasion, and at its discretion, Group Sima Inc. reserves the right to modify the present terms, and only Group Sima Inc. has the right to do so. If we modify the present terms, we will post the new terms on the website and will indicate the latest update. Modification of the terms will take effect when the revised version is posted, and by purchasing products or services on the website after the new version is posted, you will have accepted the new terms.

Modifications, Typos, and Errors

Subject to applicable laws, we:

a) reserve the right to modify products and services advertised or offered for sale on the website, prices and specifications of these products and services, and any promotional offer, at any time and from time to time, without notice or liability to you or anyone else;

b) cannot guaranty that the products and services advertised or offered for sale online will be available when ordered, or thereafter;

c) reserve the right to limit quantities sold or offered for sale;

d) do not guaranty that the site, or the documents which appear on the site, are exact, complete, reliable, up to date, or free of errors;

e) reserve the right to cancel an order, terminate or not treat (including an accepted order) if the price or any other important information on the site are incorrect; and  

f) reserve the right to cancel an order if the inventory of an item is not sufficient to complete your order (or if an item is no longer available).

If we cannot process an order for one of these reasons, we will notify you that the order has been cancelled and you will not be invoiced for the amount of the order, and we will credit you according to the type of payment used. Some provinces or territories may not permit the exclusion or denial of certain implied warranties, so some of the terms in this clause may not apply to you.

Information and our Expressed Protection of Customers' Private Lives

We rely on the information you give us to supply you with products ordered online. You agree:

a) that all information you provide, including your name, address, shipping address, credit card number(s) and expiry date(s) are current, correct and comprehensive; and

b) that you are solely responsible for any damage, cost, loss or claims that you, we, or any other person may submit or incur as a result of your failure to provide updated, correct and comprehensive information.

By purchasing online, you agree to receive emails related to this website and/or any other information, promotion/offer SIMA Group Inc. considers important to inform you in accordance with Bill C-28.

Applicable Laws, Jurisdiction and Prosecution

The present terms are governed by the Laws of the Province of Quebec, applicable to agreements made and executed entirely in the Province of Quebec, and construed in conformity with these laws, with the exception to private international regulations, or to conflict laws that would cause the application of another law. Regardless of where you access this site from, you agree that any action of rights or of equity arising from these terms, or relating thereto, will be filed only in the federal or provincial courts located in the Province of Quebec (Judicial district of Terrebonne), and determined by these, and to irrevocably and unconditionally rely on the exclusive jurisdiction of these tribunals and venue for any action, proceeding or action arising out of these terms.


Any provision of the rules declared unlawful, void, or unenforceable for any reason whatsoever shall be deemed divisible from the terms and shall not affect the validity and enforceability of any remaining provisions.
